This paper argues that AI regulatory tools developed over the past decade based on concerns about predictive AI are not suitable for generative AI. We analyze the limitations of existing regulations in four aspects: the generality of generative AI, adaptability, difficulties in effective evaluation, changes in the ecosystem of stakeholders and experts, and the distributed value chain. Therefore, we assess the applicability of existing policies and argue that new policies are needed to address the unique risks of generative AI, and present three policy recommendations that effectively identify regulatory objectives and leverage constraints across the broader ecosystem.
