Welcome to Shardee.
Shardee is a camera app that allows users to capture 1-second video clips and combine them into a single video, helping preserve everyday moments, travel memories, and personal stories.
These Terms of Use ("Terms") govern your use of the Shardee mobile application ("App") operated by DIARO ("Company", "we", "us", or "our").
By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

Shardee is rated for general audiences and may be used by anyone.
Users must comply with applicable laws when using the App.

2. Description of the Service

Shardee provides the following features:
1-second video recording functionality
automatic combination of multiple clips into a single video
basic editing features
premium features available through in-app purchase
contact/support feature
Shardee does not require account registration.
Some features rely on third-party services such as Apple App Store, Google Play Store, and Firebase.
We may modify, improve, or discontinue parts of the App when necessary.

3. User Content

Users may create video content using the App ("User Content").
User Content is stored locally on the user's device.
The Company does not claim ownership of User Content.
Users are responsible for ensuring that their content:
does not infringe copyright, privacy, or other rights
does not violate applicable laws
does not include unlawful or harmful material
Users are solely responsible for the content they create.

4. Acceptable Use

You agree not to:
use the App for unlawful purposes
copy, modify, or reverse engineer the App
interfere with the App's normal operation
use the App in a way that harms others or the Company
create content that infringes intellectual property rights

5. Payments, Digital Content, and Refund Policy

Some features of Shardee are offered as digital content or premium features through in-app purchases.
Payments are processed through:
Apple App Store
Google Play Store
The Company does not directly collect or store payment information.
All billing and refunds are handled according to the policies of the respective app marketplace.
Digital content may be made available immediately after purchase.
To the extent permitted by applicable law, when digital content is provided immediately, the right of withdrawal may be limited.
For users located in the European Economic Area (EEA):
By purchasing digital content, you acknowledge that the service may begin immediately after purchase.
You understand that your right of withdrawal may be limited once the digital content has been provided.
Refund eligibility is determined according to Apple App Store or Google Play Store policies.
Prices may change without prior notice.
If subscription features are introduced in the future, payment terms will be clearly disclosed before purchase.

6. Privacy and GDPR

We value your privacy.
Shardee does not require account registration and does not directly identify users.
Firebase Analytics is used only after user consent where required by applicable law.
Personal data may be processed for the following purposes:
providing App functionality
improving App stability
improving user experience

If you are located in the European Economic Area (EEA), you may have the right to:

Users may contact us through the in-app support feature.
When submitting an inquiry, the following information may be transmitted:
email address (optional)
message content
attached images (optional)
device information (e.g. device model)
operating system information (e.g. iOS version)
app version
This information is transmitted via Discord webhook solely for the purpose of responding to user inquiries.
Providing an email address is optional, but responses may not be possible without contact information.
Users should avoid including sensitive personal information in inquiry messages.
We do not use inquiry information for purposes other than responding to support requests.

9. Third-Party Services

The App may rely on third-party services including:
Apple App Store
Google Play Store
Firebase Analytics (after consent where required)
Discord webhook (for support inquiries)
These services operate under their own terms and privacy policies.
We are not responsible for the practices of third-party services.

10. Service Availability

We do not guarantee that the App will always operate without interruption.
Service availability may be affected by:
device performance limitations
operating system updates
internet connectivity
technical issues
We may modify or discontinue parts of the App when necessary.

The App is provided "as is".
We do not guarantee:
uninterrupted availability
error-free operation
compatibility with all devices
specific results from using the App

To the extent permitted by law, the Company shall not be liable for:

loss of profits
device malfunction
indirect damages
content loss
Liability shall be limited to the extent permitted by applicable law.

13. Intellectual Property

All rights related to the App are owned by the Company, including:
software
design
interface
branding
You may not copy, distribute, or modify the App without permission.

14. Changes to the Terms

We may update these Terms from time to time.
Updated Terms will be posted within the App or related pages.
Continued use of the App constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by applicable laws depending on the user's location.
Consumers located in the EU may have additional rights under local consumer protection laws.
